Federal Discrimination Probe Targets Baltimore County
A Department of Justice letter requests information on minority hiring in police and fire departments.
Baltimore County's police and fire departments are being investigated for possible discriminatory hiring practices.
The county was notified of the investigation Jan. 30 in a two-page letter from the U.S. Department of Justice's Civil Rights Division that was obtained by Patch.
County Executive Kevin Kamenetz apparently acknowledged receiving the letter in a 10-page letter to Rep. Elijah Cummings, according to the Baltimore Sun, which first reported the probe.
In the letter, Kamenetz "acknowledged that women and minorities have been "underrepresented" in the fire department and in some sections of the police department," The Sun reported.
Don Mohler, a county spokesman and Kamenetz's chief of staff, declined to release the letter to Cummings referenced in the newspaper report.
"At the present time, the Department desires more information regarding the hiring of African-Americans in the protective services positions within the Baltimore County Police Department and Baltimore County Fire Department so that we may fully evaluate whether or not the County is in violation of" Title VII of the Civil Rights Act of 1964, reads a Jan. 30, 2012 letter signed by Thomas E. Perez, assistant attorney general.
"Title VII prohibits an employer from discriminating against an individual on the basis of race, color, religion, sex or national origin," Perez's letter states.
The investigation of county government is the latest by the Department of Justice. Currently, the county is in negotiations with the department on violations of the Americans with Disabilities Act involving 13 county employees.
More than a dozen other complaints filed since last summer are reportedly under investigation by the Equal Employment Opportunity Commission.
Last month, the county settled a lawsuit with a police department applicant who sued, claiming he was rejected because he had diabetes. The county settled that suit for $95,000.
In August, the county lost an appeal in federal court and was ordered to pay Detective William Blake $225,000 plus interest for the April 2010 jury decision. The county ultimately will be responsible for paying legal fees, which currently total nearly $600,000, to Kathleen Cahill, Blake's Towson-based lawyer. A petition is pending on the final award of the legal fees.
"It seems only the federal government will make this county obey the law," said Cahill.
"It is astounding to see a government behave like this in the year 2012. They apparently believe they are above the law," Cahill continued. "[The county's] blatant violations of the ADA have persisted for years, unabated. They have even broadened their scheme after the Department of Justice advised them that they were violating the law."

Total nonsense. Both these departments are searching for the qualified people for the positions. Everyone that applies take a written entrance exam, physical agility test, background test and interview. After this point you would think you pick from the top of the list. How does one race have an advantage over another? Here is a question do you want the top qualified person coming to your emergency or a person coming to you emergency that was hired due to skin color or sex?

I have been speaking about the ADA issue for years. Homan is the impetus for this mess. Recently the feds meet with Homan, and county officials. They feds are not pleased and I would suspect a major lawsuit headed the county's way.
The ADA cases continue to mount and along with the possible awards the legal expenses could reach into the millions.
This goes back to the retaliation against Col. Kim Ward and FOP President Cole Weston. They stood up to Homan and paid the price.
Along with the discrimination issue it all goes back to leadership.

Maybe they don't want to be firefighters or police officers. Maybe those who want to be firefighters or police officers can't pass the tests or don't meet the minimum requirements to enter the program.
The county certainly openly promotes minority hiring. Not sure what you can do if they don't want to do it or are not qualified.
Not sure why Cummings is involved.

But let's not forget, they're only a reflection of the population. Meaning there are ppl in Baltimore county who don't a black officer respond to their homes. Al, I live in the real world my man. The world of no excuses. If what you are saying is correct, we have a democratic governor, a democratic county executive, a democratic house and senate. Then this group must be held responsible and you should look to elect other leaders as they are dicriminating. I do believe that minorities who are qualified for these jobs are more interested in the college route. Who can blame them? Who wants to rolling around parts of Baltimore County to get shot at when you can go to college?
IN MY OPINION, once the college bound pool is depleted, the remaining pool of minority candidates do not have the qualifications you listed above. If this is the case, once again, this did happen under democratic leadership and policies.
You need to look at what is really happening here. White or Black or Asian or whatever, if you cannot speak or read properly or do not know how to present yourself, you will not do well in this economy.
Education and skills that stay with the person and are transferrable will be the keys to success for people. Depending on the government, private companies, buddies, hitting the lottery will not work.
Don't shoot the messenger, don't blame the man. If you want change, make that change - in your elected leaders, in the work ethic or the next generation, etc. No more money will be used to solve these issues. We are tapped out. Change must come in the people themselves for themselves.

I am a former Baltimore County Police Officer and not only is that a trivialization of the responsibilities and requirements to join the department, but it is grossly idiotic. Do you really want someone who can only do those things protecting the citizens of Baltimore County.
First of all, they can only work with the candidates they have. The process weeds out the people who are wrong for the job. If that leads to an imbalance by race or gender, they try again for the next academy class to re-balance it. End of story.

Designed by who? Are you saying an effort is in place right now in our public schools to make sure minorities are specifically not being taught so they cannot qualify for these positions?
Are you saying political leaders and the people who work for them are specifically hiding, losing or doctoring up applications of minorities to make sure they are not admitted in these programs?
Are you saying those minorities who are admitted in those programs are specifically being targeted to make sure they drop out of the program before completion?
If this is the case, those leaders are all democratic. Yet minorities continue to vote overwelmingly Democratic. Why would people not vote in ther best interest? Why would people continue to do the same thing yet expect a different result?

Candidates are also disqualified for drug use .Simple pot conviction can follow and 18year old for life especially in this field.I believe this should be looked into a lot of qualified people make mistakes when they are young if they clean up tier act they should be allowed to apply.

This issue is a about a qualified or persons who's turned away for bias reasons. How many black or Hispanic ranking officers are in Baltimore county police. How many, past and present. How many are charged severly for minor incidents while there white counter parts are slapped on the wrist for an equal offense. Can't use the qualifying excuse there. So stop with the foolishness. You are the one trying to redirect. The probe is into HIRING PRACTICES, not promotional practices or disciplinary practices. The qualification process that weeds out people who cannot do the job, for academic, physical, psychological and other reasons, weeds out all races and genders for these reasons. If there is an imbalance after this process, the reason has nothing to do with race or gender, it has to do with hiring the best, most qualified police recruit.

Blaming other people is no longer acceptable. The Democratic leaders which the minority community have supported with 90% to 95%of their vote have their folks in at all levels of the government. It is one of two items. Either your democratic leaders who you have overwelming supported are actually discriminating against you or the minority community can not produce enough qualified people for these positions. It is that simple. Stop blaming the man - you are the man!
Complaining about it won't help, excuses won't help. Demanding change of both your leaders and communities MAY help, but no guarantees.

Hasn't anyone noticed this area is changing and becoming more crime ridden as this area becomes more 'diverse?' It makes me very nervous. I agree with equal opportunity, but this whole thing concerns me. Hopefully, just employing qualified officers will help restore our area to what it used to be and should be. If the more qualified officers are of a certain race or gender than so be it.

It takes a very special person to take the abuse that most police officers take on a daily basis. From the public they serve as well as the supervisors they work under. It also takes a very special person to run into a burning building and stay in it. No ammount of training can create the personalities needed to function well in these stressfull jobs. It does not surprise me that they have trouble finding qualified Black candidates. It surprises me that they find ANY qualified candididates. One bad cop can cause community problems for decades. No one applauds the 100 good cops who quietly do their jobs day in and day out . Everyone wants to second guess cops. You always hear well why didn't they arrest so and so. Or the other side, gee why DID they arrest so and so. We want the cops to be judge and jury unless we or one of ours is going to be arrested then we scream about police brutality and badge heavy cops . Finding someone who can keep a level head while dealing with the situations they deal with has to be by its very nature a discriminating process. Cant hire a wimp, Cant hire a bully. Gotta find someone with the wisdom of Soloman, the patience of Jobe who is willing to work at public servant wages. Now once you find someone like this how do you weed out ones who can also lead others. And then lead those leaders and so on up the chain of command. There is no magic fix and assigning quotas will not fix this.

The numbers of minorities being hired or being promoted is no fault of their own. Over the years entrance exams and promotional exams have been dummied down to equal out the quota “whoops I should not use that word” I think each department goes out of their way to hire minorities. They go to minority colleges, schools and community events to try to boost the quota “damn I used it again” But until they can pass a written exam, pass a physical fitness test and pass a background and drug testing the numbers won’t be there. If you want to look at a department that hires with bad practices look at Baltimore City if you’re a minority and have a pulse you’re hired and their services to the public is reflected in that.

Here are some interesting issues on the subject. The testing for entry into the department is established at a eighth grade reading level. GED's are accepted to meet the graduation requirement.
The county has an affirmative action policy. The county follows the Maryland State Police Training Commission guidelines. As a accredited agency it must also follow the CALEA standards.
Background investigations include such issues as drugs, employment history, employment eligibility - reading skills - and credit history.
Two agencies in the state that require the minimum of a AA degree are. Howard County and Montgomery County.

Most county, not all but most county cops couldn't and wouldn't work in the city cause of all the stress that come with city life. There is no test but life that can measure a mans heart and will. But I served in the military and my community and now I employ others so they can feed there families. But when u only judge base on race and not character. We all lose.

Those issues are all taken into account. Those policies apply across the board and have nothing to do with race.

This is issue is not the blunder of the County Executive or Buzzes best friend Fred. It’s the fault of the Fire and Police chiefs. Its basic politics 101 and when you leave someone in office for to long they self anoint themselves untouchable. These self-anointed dictators believe they are above all others. They convince themselves that there own rules and regulations, the County Code and the law does not apply to them. They take care of whom they want to take care of by promotions, bonuses, and better assignments. The ones they don’t like get the shaft or sent to work purgatory. That’s right my friends I did say inside non-competitive promotions, bonuses, and better assignments. This happens and has happened and the nerve of these two so called leaders, when the County and their employees tightening their belts, take on more responsibility, work more for less. These two men are taking care of whom they want because that’s what they have been allowed to do unchecked and unaccountable. If the County Executive is guilty of anything its not having the gonads to get rid of these two. So again why if the Federal Government investigating the Baltimore County Fire and Police Departments hiring practices? Its not so Mrs. Cahill can make a lot of money off of the County. No it’s because the Fire and Police chiefs have been in their positions way to long.

I agree, people just keep playing the race card. It must stop. There is black tv, black magazines, black clubs, black radio stations...now THATS racism. Cut out the 'playing the victim' and move on.
The caucasian race now seems to be at a disadvantage because of all of this. I have heard of many instances where the caucsasian person was not accpeted because a minority person was required to meet some ridiculous 'quota.'
Caucasian people fight for people of minority status to be included in things, for whatever reason...but do they not see that typically ruins the community or organization? Obviously this does not apply to all people of minority status, but its an obvious fact that once that 'diversity' increases the white people leave and the organziation implodes on itself.
From my experience, black people look out for other black people. They are typically more racist towards white people than anything. That is the reality.

Did you know that here in America, there was a place where blacks created there economy and community separate from the gov and was destroyed for it. Do you realize that most of things you use in your everyday life was evented by a blacken or woman. Do know how much land was stolen from blacks and how many organs was taken unknowingly. This issue is only about jobs and education. But it really goes much deeper than that ma'am.

Al, this is a sad situation. You keep looking in the past. Other "minorities" are cleaning your clock economically. Asians come here not knowing the language, yet they manage to learn the language, assimilate and work very hard to get ahead. And they are doing so. You just don't get it. The black community needs to ask for help, not money, but to help them learn to succeed and funcition in society. It must come from the black community. The problem is this is a business to your leaders. The politicians are more than happy to pander to get your vote. The race hustlers don't want things to get better, because they would be out of a job.
In the meantine, your community and your people are getting destroyed. Those who do well in professional positions are called Oreos. You simply cannot get employed with your drawers down and your underpants showing and your shoes untied. That is both a black and white problem.
If you would ask people who have done well in society to help and tell them to be brutally honest about helping you, you will have a chance. But the problem is any type of critical comments immediately bring out the race or bigot card. So why bother. You have to want to help yourself before anyone can help you.
They are too worried about get their hands on the next pair of Air Jordans instead of obtaining skills that will help them own the company that sells Air Jordans.

Al. Why is it time for White America to pay a price? I never did anything to you for you or against you so why do I have to pay anything? Why is it that when affirmative action started Black youths were trying to get educated and worked hard and now 40 plus years after the civil rights movement Black youths walk around with their underpants hanging out and call their women biatches and ho's and have no respect for themselves or anyone else. Based on the results I see I would say being given preference in jobs, education and everything else affirmative action has provided has been a dismal failure at best and more likely has destroyed Blacks in general. In all fairness its not just Black youths but todays youth in general who think this is the way to act. The good kids who behave and work hard get pushed aside in the schools while educators pour resources at the kids who could care less and whose parents could care less. Is it due to a breakdown in the family unit or a Whitey conspiracy Al? Kids who are raised to believe hard work and perserverance will get you ahead are typically the ones who get ahead. Kids who are raised to think society owes you something and blame whitey or blame the police, or blame the teachers or blame the government just keep going through life finding new excuses and people to blame cuz after all none of it is their fault. Can't be a Whitey conspiracy Al cuz this mentality is destroying white kids too.BTW, More land was stolen from American Indians!

The facts are that the BCoPD HIRING PRACTICES are fair and balanced. If the qualified candidates are of ANY color, they will get an offer to join the department. I am a former officer. I applied 3 times. I was offered two out the three and declined once to finish my college degree. Race is not a factor in the process, regardless of what you all think, one way or the other.

Personally I feel anyone who applies for a position in the Balto.,Co. police or fire department and takes the tests and qualifies should be accepted. Race should not be a factor in their acceptance if the County truly wants the best candidates.

Sue, isn't it interesting the the NFL, the NBA, MLB and the PGA are based on one issue and that is talent.
The reason is money talks and the rest walk. When there is big money on the line you want the best, i.e. Rice, Woods, Ruth, Jordan and the rest of the Hall of Famers.
Just look at the ladies golf tour the LPGA. Most of the dominant players are from across the ocean.

I sent a letter to Mr. Cummings in regards to his involvement in this matter. I expressed my concerns of his allegations of diversity in promotional testing and promotions. Everyone is giving the same allotted time to study, with the same study material and giving the same test so where is the problem? I then asked him would he look into the diversity issues of the NBA and the Miss Black America pageant. So far not a word from him.

try this test have a white person go on channel 22 on the Citizens Band Radio and listen to the warm reception you will get,,,,and I quote " This is a predominantly Black channel" it is a desiignated black channel according to that person,,,,,,,, there were two latin terms used in law school . (de Facto & de Jure ) . one denoted a segregation just naturally (socially) and then there was the other., determined by law (affirmative action is a good example). it has happened naturally, that channle 22 is a predominately a black channel ,,,,,,,,,, there is no predominately white channel, just an observation,,,this is a natural social effect..people like to be with those they can relate to.......... having said all that, Im not saying it applies here to hiring in Balto Co, but I will say this,when people like Al say that the amount of people form his race arent proportionally represented to the local population,,,,its not by design, Al. its occurring natuarally,,,,,,,,,,, every time you disagree with alot of black folk you become a racist.........not all of them. but Id say a very high percentage. it makes you sound so shallow !! have you ever heard a black person say this : "Blacks dont have the power to be racist" ( to discriminate it infers) ? which is a fallacy, go on channel 22 and you;ll see what I mean (hear) and tha'st just one example. why is there never a hate crime charged on a black person ? ...what is The Van guard justice society? no white allowed

Eastsider, after the testing phase at the entrance level, the county's policy is to place the minorities at the top of list in order that they may be processed first.
If challenged on that issue alone, you might find a case of reverse discrimination.
I always refer to the the wide world of sports where no matter who you are the bottom line is winning and not race.

Look at the problems in the city. Read the mayor's remarks on the officer just suspended over hiding the weapon issue.
