North Point Officers Exonerated In Shooting Death Of Joshua Lopez

In a letter addressed to the Baltimore County Police Department's Homicide Division, Deputy State’s Attorney Robin S. Coffin wrote that the North Point Precinct officers involved in the shooting death of Mr. Joshua Lopez were justified.

Mr. Lopez was in the Navy and lived in Texas at the time of this incident this past fall. The findings were based on the police investigation of the shooting which started when neighbors called 911 to report a suspicious subject in the area of Seaside Road and Dunnmanway in Dundalk on Sept. 23, 2012, at 2:15 am.

At the time of the incident, police spokesperson Lt. Robert McCullough issued a press release to Patch that stated the following: "The officers were attempting to interview the subject when he became combative. The subject then suddenly attempted to take one of the officer's firearm. Fearing for the officers' safety, a second officer pulled out his firearm and shot the subject." 

Officer Twisdale suffered injuries as a result of the confrontation.

The police department’s Homicide Division investigated the incident and submitted its findings to the State’s Attorney’s Office, which reviewed the case.

The letter to the Homicide Division was dated Oct. 31, 2012, and was obtained through the filing of a PIA (Public Information Act) request. It reads as follows:

“Dear Lt. Duty:

I have reviewed the investigation in the above-referenced matter and the actions of Officers Twisdale and Heins.  The officers attempted every non-lethal use of force available to subdue the suspect, Joshua Lopez.  As the suspect attempted to remove Officer Twisdale’s handgun, Officer Heins had no choice but to use deadly force.  It is my conclusion that the shooting of Lopez was justified.  The conduct of Officer Heins was well within the law and necessary to protect both officers’ lives. Accordingly, this office will not take any further action.”

The letter was signed by Robin S. Coffin, Deputy State’s Attorney for Baltimore County.

According to an officer inside the Homicide Division who spoke on the condition of anonymity, the division has been in touch with Mr. Lopez’s father, who is also from Texas and a law enforcement officer.  Mr. Lopez (the father) was invited to come to Baltimore County and meet with investigators.

According to police spokesperson Cpl. Cathy Batton, and a story covered by Patch in the initial reports, incriminating evidence was found in Mr. Lopez's possession.

This blogger spoke to Cpl. Batton who advised that the police located Mr. Lopez’s vehicle and found numerous stolen items including some of which they are still in the process of notifying the owners.

Jim thanks for your comment. I thought the community should know the whole story. I feel bad for the family but many others have been through some similar situations.

This also clears the officers who did what they were trained to do. I can't imagine what they went through after the finger pointing. Maybe now the healing can begin for the family and the community.

At least this sets the record straight.

I'm sorry, but this doesn't say a thing as for what really happened. I want to know how an unarmed man, versus two police officers, goes from questioning to killing. Yes killing. That's what needs to be answered.Justified, Yeah!!!.We have heard two many stories, and when one officer is fighting with a suspect and another officer comes on the scene, the one officer not in the fight, is not going to shoot the suspect without fearing possibly shooting your own partner. My son was shot twice in the head, at close range. That's not a shot or shots that one officer would take to protect another. Also, where was the officers gun? Did my son have the gun out and ready to use it or was it still in the holster? It doesn't say that. The above report says there was a subject, not subjects. Where were the other guys? In all the reports that we have read, it says there were numerous subjects. Where are they? Where is the video, that shows the subjects, where is the stolen property?, Also, its says my sons car. That car belongs to a Sean Hensley, who was arrested by the Navy for theft. The items were his and not my sons. But it is easy to blame the dead guy. Oh yeah, supposedly these crimes were going on for a while, and this was my sons first time to this area. He was deployed and just came from Texas on leave. There are alot of questions that need to be answered, so don't think this is over. Oh yeah, I would like to see who invited me to come up to baltimore.

Why do you continue to deny the truth? Read what I wrote. All the rules were followed and they bent over backwards to get the truth. What was your son doing with the stolen merchandize in the car? What was he doing on the street at 2:15 am?

That's like criticizing our troops who engage combat and second guessing their action when your weren't there.

There are three issues, one the timing of he incident 2:15 am, second what the witnesses saw and third the confrontation. If your son was with Sean then he is involved according to the law. Why did he just not answer the officers questions? Why did he resists? The officer suffered injuries and you don't get those by talking.

As soon as your son became combative and made an attempt at going for the officers weapon the lives of the officer became at stake. You don't wait for the suspect to get hold of the weapon.

Tell me how many police officers are killed with their own weapons in similar incidents?

Is it not possible that before the police arrived that the suspects split up and headed in different directions. You seem to deny any evidence that is presented. Your mind is closed.

Isn't is strange I received three request on Facebook from members of your family to be friends. What was the reason for that because judging by your response I doubt I would be considered a friend because I wrote the facts according to the law.

I can imagine what you are going through but the police did what they were trained to do.

Buzz, i see all the comments and still do not feel better. Why was my son out at 0215, I do not know. Maybe he could not sleep. He was suppose to spend the night at the friends house he just dropped off. I still would like to know where the other guys are. We have heard so many stories. None of them are alike. Once again, the car belongs to Sean Hensley, not Josh. Sean insisted on Josh taking his car. Huh, wonder why. This was my sons first time in this area, so you cant blame him for all the crime in the area. I guess the police are not up with the times in this area, because they do not have dash cams or tasers. Batons are old. But yet the police beat the crap out of my son, pepper sprayed him and still he got two shots in the head. Oh yeah, he was unarmed. We will get the truth out and than we will rest, but not til than. To the Officers, I'm sorry for your cuts and scrapes. I hope they heal quickly, because ours won't. I understand the job and the dangers, so please don't think I'm unaware of what you do. But I do know, there are right ways and wrong ways to do the job. If you hide behind the badge and think you can do anything and not get caught, one day the badge will break. The truth will come out and I pray it will be good. If not I will live with that, but right now we just want the true answers and not all the stories that are different in every way. Also, justifying 2 shots to the head for not answering questions sounds kinda gangster to me. Just speaking.

Here's the issue. I'm not saying Josh was perfect. I'm not saying he never made mistakes. Even if he was flawless in my eyes. "Lol" here's what I am gonna say. Sean talked Josh into taking his vehicle to drop off the friend in Maryland. It's a what, approximately 6 hour drive. They left Saturday afternoon arrived in Maryland 6 hours later. That's why they were there so late. Sean wasn't even there but it was his stolen property in his vehicle. Again, I'm not saying josh was perfect... He may or may not have been doing illegal things that night... But the stolen property they are talking about belonged to Sean since it was his car... he was later arrested for that but then charges were dropped despite a few other shipmates testifying against him.

Lastly. According to the police report, the injury that officer twisdale received was basically a slap on the hand. Also, his dad, Mr. Lopez has received no invitation to talk. In fact, he has called numerous times and has gotten no where. You're not going to convince me that two officers who claimed they used batons and whatnot to subdue him couldn't take down a 5'7 man who was unarmed. From what we've been told, Josh was in a bear hug on the ground with the other officer and that's when Officer Jacob Heins shot him... In the head... Twice.... If y'all label combative as touching an officers hand and that justifies two shots to the head, I don't even want to know what a punch to the gut would cause. Although, y'alls track record shows just how trigger happy y'all are. We want to know the truth. Things don't make sense to us... Or other people... Including law enforcement people who have contacted us just to tell us that everything sounds wrong. I realize Josh is gone and he's not coming back... But because I had to watch our wedding date come and go without getting married, I'd like to hear one story that doesn't contradict the other ones that we've been told. I'd also appreciate if it makes sense.

However, for now, I'll continue to lean on God and family for comfort and pray that he helps me to forgive both officers and the roommates. I intend on meeting officer Heins face to face one day, but not before I've completely forgiven him. I need to put a face to the name of the man who murdered my best friend, someone who I have known since I was ten years old, someone who I was ready to marry even if it meant leaving my family and friends behind in Texas to support the most amazing man I've met.

Melisa stop using the word murdered. That is not true. You are not family and have no business making those statements.

Instead of using your heart solely add your brain to that equation. You really think this officer wanted to go through this and just murdered your love.

You need to do some soul searching. Accusing a police officer of murder is a serious accusation and judging by your statement I would ponder those words.

I just wrote what the police said happened. You choose to ignore it. Read page two of the report on the officer's injuries.

I am curious, why did you send me a friend request on Face Book? I know who you are but that is your business. Seek out the truth and ask to meet with the detectives over these issues. Unless you know all the facts I would suggest you temper your words.

The one thing I asked Mr. Lopez and have not received and answer, what was is son doing out at 2:15 am in the morning. The car was nearby with evidence in it. There were eyewitnesses that pointed the police in the right direction.

You know nothing about police work and that slap you refer to could have something to do with the officers weapon. You were not there remember!

You say Mr. Lopez received no innovation to talk and yet why has he not responded to my question? He brought it up. As the father don't you think it makes sense for the police to interview or talk to Mr. Lopez about his own son?

Lowe] bullshit, everytime he works this place gets hassled." Sergeant Webster testified that Beeler "advised me that the police should leave Mimi alone because he takes care of all of the Parkville Police. I asked him what he meant and he said, you know what I meant." In addition to the presence of other police officers, there were several citizens in the vicinity when Beeler made his remarks. Some of the officers were angered and embarrassed by Beeler's remarks."

This is joshua's mother....batons to be used below the collar bone and down. My son had strangulation marks ..lumps and indentions and numerous bruises to his face that was Cleary seen through the dark makeup that was used to cover the bruises...I could not touch my sons face because it was reconstructed. Five different scenerios. All different stories. Which should our family believe?

My husband has not been invited by anyone anywhere. Joshua"s car was in Virginia. Sean' s car was found. The other suspects heard the gun shots. An anonymous person witnessed what happened and made a fake facebook page saying don't believe what they are printing. And then another. I am not angry but have a heart to forgive those that do wrong and justify their wrong by fabricating stories. Five different stories told to our family. Our calls have not been all taken. We get the run around.

Also I (his mother) plan to visit the very spot if was shot in. Bring a bucket or two, scrub brushes and cleaning materials to cleanup any blood that people were so disgusted by. I want the truth and will go through whatever it takes to find out what really happened that night. I friend requested you for you to get to know our family and where Joshua came from. To read our day to day before and after josh's death. I spoke on the phone that day with Joshua as he was driving about his soon to be nuptials...in fact he spoke with us all that day. A man that as a boy never was insubordinate and stayed home on the weekends and held down three jobs at one time in his life. After almost four years in the navy decides to become combative with an officer. No dash cam? I want to pictures of my dead sons body and the pictures of the officer in the struggle. He would have blood splattered on him and possibly brain matter. He had gloves but they found fingerprints?which is it ?
