Woman Pleads Guilty to Hiring Her Brother to Kill Her Husband

The state is recommending 60-year prison sentences for the woman and her brother, the gunman.

A Dundalk woman, Jaclyn J. Martin, on Friday became the last of four suspects to plead guilty for their roles in the murder of Martin's husband who was gunned down outside a Dundalk bar in May.

The admitted trigger-man, Robert M. Garner, Jaclyn Martin's brother, pleaded guilty to first-degree murder in the killing of his brother-in-law, Lee Martin, in November. Garner is awaiting sentencing along with two others. Sturm R. Davis has pleaded guilty to armed robbery for his role in the murder, and Brandon Roth, the getaway driver, pleaded guilty to first-degree assault. 

The Baltimore County State's Attorney's office has recommended a sentence of 60 years in prison for Jaclyn Martin, 31, of 7006 Railway Ave., and also of 60 years for Garner, 26.  Prosecutors are asking for 10-year prison sentences for Davis and Roth, who were both 19 at the time of the killing.

According to court documents, Jaclyn Martin offered Garner $10,000 to kill her husband. She also gave Garner her husband's bank card which Garner used to withdraw a total of $987 to purchase a .22-caliber handgun that he used to shoot Lee Martin. Martin was shot eight times in the head, neck and chest outside the Hops Inn.

Roth and Davis told police they were at a drive-in movie when Garner called them to his apartment, according to a Baltimore County State's Attorney press release. When they got there, Garner was dressed in black with black face paint around his eyes. He gave Davis dark clothes and told Davis and Roth that he was going to beat up a guy, court records stated.

At Garner's direction, Roth drove the three to a street near Railway Avenue where Davis and Garner exited the car and walked through a break in the fence to the stairs on the side of the Hops Inn. While there, Garner called and spoke with Jaclyn Martin to make sure she wanted her husband killed, according to the description of the crime in court records.

When Lee Martin exited the Hops Inn, Garner approached him and demanded money. Martin appeared frightened and said he did not have any money, according to court records. Garner then pulled out a gun and after Martin turned over some cash, Garner started shooting.
